La declaración de inconstitucionalidad del delito de violación sexual y su incidencia en la lucha contra la prostitución infantil, en el distrito judicial de Lima, 2017

Abstract

La presente investigación tuvo como objetivo establecer la manera en que incide la declaración de Inconstitucionalidad del Delito de violación sexual previsto en el inciso 3 del artículo 173 del Código Penal por parte del Tribunal Constitucional (Exp. N° 0008-2012-PI/TC) en la lucha contra la prostitución infantil. Se utilizó para alcanzar dicho objetivo el método descriptivo y un diseño no experimental, asimismo la población objeto estuvo constituida por 700 operadores del derecho, entre ellos Jueces, Fiscales y Abogados Litigantes en materia penal. Al calcular el tamaño de la muestra se trabajó finalmente con 248 personasThe investigation had as objective to establish the way in which the declaration of Unconstitutionality of the Crime of sexual violation provided for in paragraph 3 of Article 173 of the Criminal Code by the Constitutional Court (Exp.
