Importancia de la investigación preparatoria en los delitos de corrupción de funcionarios en el nuevo código procesal penal

Abstract

La investigación preparatoria tiene una especial configuración, dado que son los cimentos necesarios para dar lugar al juzgamiento, teniendo las pruebas necesarias y suficientes el Juez podrá dictar la sentencia respectiva para los funcionarios que cometieron actos de corrupción en su institución. El objetivo general del trabajo de investigación fue demostrar si la importancia que tiene la investigación preparatoria, incide en los delitos de corrupción de funcionarios en el Nuevo Código Procesal Penal. Además el tipo de investigación fue descriptivo y el nivel aplicativo; por otro lado, el método y diseño de investigación fue expos facto o retrospectivo; y con relación a la población objeto de estudio estuvo constituida por el Colegio de Abogados de Lima (CAL) y la muestra fue de 225 Abogados hábiles con un muestreo probalístico de probabilidad del 95% de confianza y con un margen de error de 5% ó 6.5%.

The preparatory investigation has a special configuration since they are the necessary cements to give rise to the trial having the necessary and sufficient evidence the Judge can issue the respective judgment for officials who committed acts of corruption in his institution. The general objective of the research work was to demonstrate if the importance of the preparatory investigation, affects the crimes of corruption of officials in the New Code of Criminal Procedure. In addition, the type of research was descriptive and the level of application; On the other hand, the method and design of the research was expository or retrospective; and in relation to the population under study was constituted by the Bar Association of Lima (CAL) and the sample was 225 skilled lawyers with a probabilistic sampling probability of 95% confidence and with a margin of error of 5% or 6.5%.
