La ética en el registrador y la seguridad jurídica en la zona registral ix – Sunarp

Abstract

En la tesis se puede apreciar que el trabajo que se ha desarrollado, cuenta con información importante, el cual ayudará a los operadores del derecho a entender, que el Registrador tiene que ser una persona idónea, acuciosa, con el fin que puede realizar un trabajo que beneficie a los usuarios que acuden a la SUNARP a realizar diferentes trámites, buscando sean atendidos con inmediatez respecto a lo que van a efectuar, y además sentir satisfacción y confianza de que en dicha institución existe la seguridad jurídica necesaria que el país debe brindarles. Respecto al objetivo general de la tesis fue demostrar si la ética, en el registrador, incide en la seguridad jurídica en la zona registral IX – SUNARP, dado que actualmente los que trabajan en la referida institución tienen que cumplir con lo señalado en la ley, a fin que los ciudadanos sientan que están siendo protegidos jurídicamente por el Estado. El tipo de investigación fue explicativo y el nivel aplicativo. El método y diseño de investigación fue Expost facto o retrospectivo. La población en estudio estuvo constituida por el Colegio de Abogados de Lima (CAL) y la muestra de Abogados hábiles, con un muestreo probabilístico aleatorio simple. Los instrumentos utilizados para la medición de las variables fueron validados por Jueces expertos para ello realizaron la evaluación 3 doctores en Derecho, quienes dieron la validación de criterios o de constructo. La prueba estadística fue 95% el margen de error utilizado fue 6.5%.

La conclusión a la que arribó la tesis fue que se ha demostrado que la ética, en el registrador, incide significativamente en la seguridad jurídica en la zona registral IX – SUNARP.

In the thesis it can be appreciated that the work that has been developed has important information, which will help the operators of the right to understand, that the Registrar has to be a suitable person, with the purpose that can do a job which benefits users who come to SUNARP to perform different procedures, seeking to be taken care of in registering their property and have the necessary legal security that the country must provide. Regarding the general objective of the thesis was to demonstrate if the ethics, in the registrar, affects the legal security in the IX - SUNARP registration area, given that currently those who work in the aforementioned institution have to comply with the provisions of the law, so that citizens feel that they are being legally protected by the State. The type of investigation was explanatory and the level of application. The method and design of the research was Expost facto or retrospective. The study population was constituted by the Lima Bar Association (CAL) and the sample of skilled lawyers, with a simple random probabilistic sampling. The instruments used for the measurement of the variables were validated by expert judges. For this, the evaluation was carried out by 3 doctors in law, who gave the validation of criteria or construct. The statistical test was 95%, the margin of error used was 6.5%.

The conclusion reached by the thesis was that it has been shown that ethics, in the registrar, significantly affects legal security in the IX – SUNARP registry area.
