Abstract
El objetivo general del presente Trabajo de Investigación es establecer la influencia de la propuesta de creación de un Sistema de Catastro Único en la efectividad de la inscripción registral en el Perú. Ello debido a que inicialmente se detecta un problema gravitante en el accionar del Registrador Público del Registro de Predios: Se presentan muchas superposiciones a causa de que cada institución generadora de catastro funciona con formas distintas de recabar la información, sistemas geodésicos diferentes y sistemas distintos al de los Registros Públicos.
Detectado el problema, se investiga la solución. La hipótesis principal es que el Sistema Único de Catastro influye directa y significativamente en la efectividad del Registro de la Propiedad Inmueble. Porque cuando se logre que todas las entidades generadoras de catastro se alineen bajo un mismo Sistema, se acabarán los problemas de superposiciones y otros, que obstaculizan las inscripciones registrales.
En las Conclusiones se sostiene que sea SUNARP el organismo que administre el Sistema Único de Catastro, y que proporcione la información catastral a todas las entidades y personas, a nivel nacional, que la requieran.
Tal fundamento se sustenta en que lograr que todas las entidades generadoras de catastro en el Perú usen un Sistema Único, con equipos propios, resulta muy costoso, y muchas no van a tener el dinero necesario para implantar el Sistema. En cambio, SUNARP, que tiene significativos ingresos propios, sí está en capacidad para instalar el Sistema Único de Catastro. No solo se trata de dinero. También es importante la experiencia que tiene SUNARP en materia de catastro. En consecuencia, SUNARP puede ser el ente rector del Sistema Único de Catastro, administrándolo y dando el servicio de información a todo el que lo necesite.
The general objective of this research work is to establish the influence of the proposed creation of a Single Cadastre System on the effectiveness of registration in Peru. This is because initially a gravitating problem is detected in the actions of the Public Registrar of the Land Registry: Many overlays are presented because each cadastre generating institution works with different ways of gathering information, different geodetic systems and different systems of Public Records. Once the problem is detected, the solution is investigated. The main hypothesis is that the Unique Cadastre System directly and significantly influences the effectiveness of the Real Property Registry. Because when it is achieved that all the cadastre generating entities are aligned under the same System, the problems of overlapping and others, which hinder registration, will end. In the Conclusions, it is proposed that SUNARP be the body that administers the Single Cadastre System, and that it provide cadastral information to all entities and individuals, at the national level, that require it. This foundation is based on ensuring that all the entities generating the cadastre in Peru to use a Unique System, with their own equipment, is very costly, and many will not have the necessary money to implement the System. On the other hand, SUNARP, which has significant revenues of its own, is able to install the Single Cadastre System. It's not just about money. SUNARP's experience with cadastre is also important. Consequently, SUNARP can be the governing body of the Single Cadastre System, administering it and providing the information service to all who need it.
